§ 1. GENERAL PROVISIONS
The Privacy Policy defines how personal data of Users necessary for the provision of electronic
services through the website http://testingcup.pl (hereinafter:
Service) are collected, processed, and stored.
The Service collects only personal data necessary for the provision and development of the services
offered within.
Personal data collected through the Service is processed in accordance with the General Data
Protection Regulation (EU) 2016/679 of April 27, 2016, on the protection of individuals concerning
the processing of personal data and on the free movement of such data, and the repeal of Directive
95/46/EC (General Data Protection Regulation, hereinafter GDPR) and the Personal Data Protection Act
of May 10, 2018.
§ 2. DATA CONTROLLER

Administrator).
§ 3. PURPOSE OF COLLECTING PERSONAL DATA
Personal data is used for:
- fulfilling agreements related to services and e-services,
- registering participants for internal TestingCup championships and verifying their identity,
- communicating with Users (contact form, e-mail, etc.),
- accounting purposes,
- sending awards and diplomas by traditional mail,
- sending newsletters (after obtaining User consent),
- promoting the Administrator's offer,
- marketing, remarketing, affiliation,
- personalizing the Service for Users,
- analytical and statistical activities,
- debt collection,
- determining and pursuing claims or defending against them.
Providing data is voluntary but necessary to conclude an agreement.
§ 4. TYPE OF PROCESSED PERSONAL DATA
The Administrator may process User personal data: name and surname, address, email address, phone
number, TAX ID.
§ 5. DURATION OF PERSONAL DATA PROCESSING

User personal data will be processed for the period:

when the basis for data processing is the performance of the agreement – until the
expiry of claims after its performance,

when the basis for data processing is consent – until its withdrawal, and after
withdrawing consent until the expiry of claims.

In both cases, the limitation period is 6 years, and for claims for periodic benefits and claims
related to business activity – 3 years (unless a specific provision provides otherwise).
§ 6. SHARING PERSONAL DATA
- User personal data may be transferred to entities related to the Administrator, its
subcontractors, and entities cooperating with the Administrator, e.g., companies handling
e-payments, courier/postal service companies, law firms.
- User personal data will not be transferred outside the European Economic Area (EEA).
§ 7. USER RIGHTS
- The User of the Service, including TestingCup championship participants, has the right to:
access their personal data, correct it, delete it, limit processing, transfer it, object to
processing, withdraw consent at any time (without affecting the legality of processing based on
consent before its withdrawal).
- Requests related to the above rights should be sent to testingcup@testingcup.pl.
- The Administrator fulfills or refuses to fulfill the request immediately – no later than one
month from its receipt.
- The User has the right to lodge a complaint with the President of the Personal Data Protection
Office if they believe that the processing violates their rights and freedoms (GDPR).
§ 8. COOKIES
- The Service collects information using cookies – session, permanent, and external entities.
- Collecting cookies supports the proper provision of services on the Service and serves
statistical purposes.
- Users can specify the scope of access of cookies to their device in the browser settings.
§ 9. AUTOMATED DECISION MAKING AND PROFILING
- User data cannot be processed in an automated way that could result in any decisions affecting
them.
- User data may be profiled to customize content and personalize the offer after their consent.
§ 10. FINAL PROVISIONS
- The Administrator has the right to make changes to the Privacy Policy, ensuring that User rights
are not limited.
- Information about introduced changes will appear in the form of a notice available on the
Service.
- Matters not regulated in this Privacy Policy are subject to the provisions of the GDPR and
Polish law.
